Terms of Use

These Terms of Use ("Terms") are an agreement between you and Depth Software LTD, a company registered in Cyprus under number HE486525, with Tax ID Number (TIN) CY60316577P, located at Efesou 9, 5280 Paralimni (Famagusta), Cyprus ("MasterTells"), for the use of the MasterTells apps for iPhone and Mac (the "Service"). They are also the app's license agreement. By creating an account or using the Service, you accept these Terms and the Privacy Policy.

1. Eligibility and your account

• You must be at least 18 years old.
• You are responsible for your account and for keeping your password and recovery phrase safe. If you lose both, your data cannot be recovered, by you or by MasterTells.
• If you think someone else has used your account, tell support@mastertells.com right away.
• Accounts inactive for 12 months are deleted, after notice by email.

2. The Service

MasterTells records or imports conversations, transcribes them, and uses artificial intelligence to write recaps, analyze them and answer questions about them. Features may change over time.

3. Your content

• You own what you record, import and write. You give MasterTells a limited license to process it only to provide the Service to you.
• You confirm you have the right to everything you record or import, and that it does not break the law or anyone's rights.
• When you share a space, the people with access can see what is in it. If you delete your account, the spaces you own are deleted for everyone unless you transfer them first, and what you imported into other people's spaces is deleted too.
• What others import into a space you share is their responsibility. What you share outside MasterTells, such as a report, is beyond MasterTells' control.

4. Recording other people

You are solely responsible for telling everyone you record and for getting every consent the law requires. Recording laws differ between countries and states, and some require everyone's consent.

5. AI output

Recaps, analyses, claim checks and answers are generated by AI. They may be incomplete or inaccurate, and they are not legal, medical, psychological, financial or employment advice. Check them against the moments they cite before relying on them.

6. Subscriptions and purchases

• Subscriptions and packs of hours are sold through Apple's App Store. Prices and what each plan includes are shown in the app before you buy.
• Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel a subscription in your Apple Account settings. Cancelling stops the next renewal; the current period stays active until it ends. Deleting the app or your account does not cancel a subscription.
• Refunds are handled by Apple under its policies.
• Packs of hours are one-time purchases and expire one year after purchase.

7. Acceptable use

Do not use the Service to:

• record or analyze anyone unlawfully, or harass or harm anyone;
• infringe anyone's privacy, confidentiality or intellectual property;
• reverse engineer, copy, resell or overload the Service, or get around its limits.

8. Intellectual property

The Service, its software and its content, other than yours, belong to MasterTells or its licensors. You receive a personal, non-transferable, revocable license to use the app while these Terms apply. Feedback you send may be used freely.

Apple, the Apple logo, iPhone, Mac, Face ID and Siri are trademarks of Apple Inc., registered in the U.S. and other countries and regions. App Store and iCloud are service marks of Apple Inc. The names and logos of the apps MasterTells imports from are trademarks of their respective owners, shown only to say that MasterTells can import their exports. MasterTells is not affiliated with, sponsored or endorsed by any of them.

9. Termination

You can stop using the Service and delete your account at any time. MasterTells may suspend or close an account that breaks these Terms.

10. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

11. Limitation of liability

To the extent the law allows, MasterTells is not liable for indirect, incidental, special or consequential damages, and its total liability is limited to the amount you paid for the Service in the 12 months before the claim. Nothing in these Terms limits rights you have as a consumer under the law of your country.

12. Apple

These Terms are between you and MasterTells, not Apple. Apple is not responsible for the Service or its content, has no obligation to provide support for it, and is not responsible for any claim about it. If the app fails to conform to any warranty, you can notify Apple, which may refund its purchase price. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you are not in a country under a U.S. embargo or on a U.S. list of restricted parties.

13. Governing law

These Terms are governed by the laws of Cyprus, and disputes go to the courts of Cyprus, without removing the protection that the law of your country of residence gives you as a consumer.

14. Changes

These Terms may change. Material changes are announced in the app before they take effect. If you keep using the Service after that, you accept the new Terms.

15. General

If part of these Terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer these Terms to anyone else; MasterTells may, for example in a merger or acquisition. Notices may reach you by email or in the app.
